The new Family and Medical Leave Law goes into effect 2019

What does this new law mean to Eastern Washington employers?

Washington State will soon be the fifth state in the country to offer workers paid family and medical leave benefits to workers. No payouts are going to be offered until 2020. However, starting in 2019 new obligations under the law will go into effect for employers. 


If you have employees, you must participate in this program. This includes non-profits, farms, and small businesses with few employees. 


What are the new regulations? 

Starting on January 1st of 2019 there will be a 0.4% premium charged on each employee’s gross wages (up to $132,900). This amount can be withheld from the employee’s paychecks, unless the employer has over 50 employees, in which case the employer is required to cover about 2/3 of the employee’s premium. 


Rule of thumb: For companies employing over 50 employees, every $1,000,000 in gross wages will result in approximately $2,500 in employer contributions required under the new law. 


In 2020, employees who have worked enough hours will be eligible to take paid family and medical leave. This leave will not be paid by the employer, but rather by the State of Washington.  


Employees can take up to 12 weeks of family and medical leave under the following circumstances (or up to 16 weeks if they encounter multiple instances of the following circumstances): 

· Child birth, adoption or foster placement.

· Serious illness or injury of themselves or a relative. 

· Family member deploying to or returning from military leave. 


Also starting in 2020, employers with over 50 employees will be required to allow qualified employees who return from the leave under this law to be restored to the same or equivalent job upon their return. 


What does my company need to do? 

If your payroll is administered by ABCS Business Consulting ,you will receive a kit that includes informational packets and required workplace postings. You or your employees directly will be provided with a mandatory pay stub insert that will instruct them on the changes coming in the next two years. 


Also, clients of ABCS will have their payroll updated to comply with the new law. We will also perform the necessary state filings and direct deposits of funds.
